Ursula Owusu- Ekuful’s anti-EQUAL bill: We if n’t criminalize sex toys

Ursula Owusu-Ekuful, the contacts secretary and member of parliament for Ablekuma West, has expressed concern over the Anti-LGBT bill’s consideration of the criminalization of sex toys in Parliament.

She claimed that heterosexual couples who use sex toys to improve their sexual lives would unintentionally be impacted by the Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill 2021’s clause 3 ( c ) criminalizing the use of such objects.

The bill’s Clause 3 ( c ) forbids having sex between a man and an inanimate object or between women and such an object.

She remarked that Parliament would need to be made aware that the bill is intended for everyone, not just the Gay area, if the house’s goal is to make sex toys illegal.

Otherwise, she has demanded that clause 3 ( c ) be deleted right away.

She stated,” And I believe we raised this when the committee was considering it, that the proposed amendment in 3 ( c ) may create unintended consequences because sexual intercourse between a man and an inanimate object, or between women, would necessarily include sexual interaction with all kinds of aids that couple use to enhance the sexual experience,” while speaking on the floor of Parliament during the Anti-LGBT bill’s consideration.

And I’m not certain if that is the bill’s intended purpose. It would unavoidably involve sex toys and other tools that heterosexual couples can use to improve their sexual experience.

” But if that is what the house intends, then we must become clear in our minds that we may be criminalizing activities that may not necessarily be restricted to only those Transgender community that this act targets, but may also be targeting straight couples who use sexual enhancement tools to improve the sexual practice.”

Therefore, we must be aware of the unintended consequences that 3 ( c ) may have, and I will suggest that it be removed from this amendment.

Parliament, however, was unable to agree on the proper penalty for LGBTQ+ people engaging in strange carnal knowledge with one another.

The bill proposes a sentence of between 3 and 5 years and makes intercourse between people of the same sexual orientation, between men or women, and between an animal or thing, illegal.

But, the Constitutional and Legal Affairs Committee did not recommend a maximum sentence and instead recommended an up to three-year prison term.

On Tuesday, December 12, 2023, the Chairman of the Committee gave a justification for the request.

The majority of spiritual organizations supported the idea that they would provide opportunities for those who are willing to undergo changes. If we enact a strict law, you wo n’t have an option if you are found guilty or you engage in this behavior. Because the society will look down on you, Mr. Speaker, we do n’t have a community service that would have been more severe than giving the person the custodial sentence.

They are also members of this world, they are educated, and depending on the situation, I am comfortable if we give the top limit without specifying that the individual may be imprisoned as a minimum requirement. However, to caution you or to give you deserve prison or imprisonment, assuming we leave it up to the judge’s discretion.

Sam George, a costs sponsor, stated that determining the severity of the related sanction may depend greatly on advice on the fines to be imposed on offenders.

The maximum penalty or 750 models should then be discussed to determine whether it is parallel with three months or six months. Therefore, there is a lower limit for judicial sentences as well, he said on the floor.

However, the Speaker intervened, stating that” that will apply because there was already a law on equality on charges products.”

Following the discussions, the Speaker deferred the questions to the political drafters so they could create a more detailed version of the conversations that would better reflect the goals of different legislators.
