The Supreme Court is urged by a coalition of states to uphold parents ‘rights in relation to transgender policies

In a situation involving the transgender procedures of sane school districts in Maryland, 17 state attorneys general are pleading with the Supreme Court to identify parental rights.

West Virginia is in charge of the coalition challenging a decision by an appeals court that found parents did not have the right to sue Montgomery County Public Schools for allowing teachers and administrators to transition children without their parents ‘knowledge or consent.

Plaintiffs in the case referred to the disputed policy as the “Parental Preclusion Policy,” which their attorneys with the National Legal Foundation claimed was a violation of their Fourteenth Amendment rights.

The Montgomery County Board of Education’s 2020–2021 transgender identity recommendations focus on a student by their identified name, adjectives, sports, recreational actions, locker rooms, bathrooms, “safe spaces, protected zones, and other health supports.”

Three parents of students at Montgomery County Public Schools filed a lawsuit over the state’s “gender help plan” in August, which was 2 to 1 dismissed by the U.S. Court of Appeals for the 4th Circuit.

Schools are not allowed to inform parents without the person’s permission, in addition to allowing students to use the bathrooms of their choice and be addressed by their chosen name and pronoun.

The rules state that the principal or designated staff member should talk with the student to find out how much support they are receiving or expecting from home before contacting a student’s parent or guardian.

According to West Virginia Attorney General Patrick Morrisey, this egregious policy completely violates parents ‘rights and prevents them from being involved in their child’s physical, emotional, mental, and social well-being. It’s a big red flag whenever any organization or entity tries to cover up what they do while caring for our children. Why did a school board advise individuals to secede from their relatives?

The partnership stated in their short that “parents ‘right to direct the attention and custody of their children is the oldest of the basic rights interests recognized by the Court.”

The small went on to say that parents must have the right to ask the courts for assistance in securing the basic right of knowing what schools are doing with their children.

The West Virginia-led small was joined by Alaska, Florida, Georgia, Idaho, Kansas, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, Texas, Utah, and Virginia.
