The American government on March 11 a law that allows undocumented people who entered the nation from Pakistan, Bangladesh, Afghanistan and another adjacent countries before Dec. 31, 2014, to receive quick- track citizenship.
Parliament in 2019 passed the Citizenship Amendment Act, which provides citizenship to undocumented people who are immigrants— primarily because they are Hindu, Jain, Sikhs, Buddhist, Parsi and Christian — who face harassment in their countries of origin. This month, the law that became effective does not apply to LGBTQ people.
LGBTQ Pakistanis encounter discrimination based on gender identity, crime, crime, threats and hate speech, prejudice in accessing work and exposure to housing. A 2016 Human Rights Watch from 2016 records the deaths of many activists and improper arrests by authorities in Bangladesh.
Bangladesh’s National Human Rights Commission in 2013 asked the government to shield the LGBTQ community from prejudice. The committee acknowledged authorities physically and sexually abuse LGBTQ people, and make arbitrary detention based on an adult’s look.
There are no reports of any Transgender Muslims coming from Pakistan, Afghanistan, or Bangladesh to India, despite the fact that India’s CAA does not fast-track citizenship for new immigrants but stones to the cut-off date of December 2014.

After Parliament passed the law in New Delhi, India’s money, more than 1, 000 Gay people are protesting against it. An MP from Bengaluru and a member of the ruling party said those who are protesting against the CAA, particularly LGBTQ people, want Muslim Muslims to enter the country.
” Let me tell all of you, you’re really misplaced. There is no such thing as a free or recognized Transgender rights in Pakistan, Surya said. Because we are not Pakistan, you are proud to pursue your LGBTQ rights, lead a dignified life around, and fight for a more respectable life in India. Therefore, if you permit all of Pakistan’s Muslims to enter India, there wo n’t be any issues with LGBTQ rights in India.
The person can apply for citizenship in India through an online portal with detailed documents that include birth certificates, rental records, identity papers and any license, school, or academic certificate issued by a government authority in Afghanistan, Pakistan and Bangladesh. The applicant must present an eligibility certificate from a reputable community organization that demonstrates that they are a member of the Hindu, Sikh, Buddhist, Jain, Parsi, or Christian community and continue to do so.
Rani Patel, an activist, and founder of, a nonprofit organization that works with transgender Indians, said the LGBTQ community is always neglected.
” Every country has a set of rules and regulations”, said Patel. ” We cannot encroach on other’s area. We can take care of our LGBTQ community. We ca n’t promise to accept your LGBTQ population. We have a huge population, and this is the government’s call”.
An activist for LGBTQ rights in Uttarakhand claimed that the Indian government has always excluding the LGBTQ community.
” I’m not surprised that the LGBTQ community in India has left the community because they have been overlooked in every way and form,” said Mohanty. ” I would have been happy, not only me but all the members of the community, if LGBTQ community has been included in this”.
