Transgender Veterans Group Threatens VA with Legal Action Due to Years-Late Covering Surgeries Delay

The Department of Veterans Affairs is under threat of legal action by a trans veteran advocacy group for its delay in providing gender-affirming operation.

Attorneys for the Transgender American Veterans Association, or TAVA, stated in a letter dated Monday to the VA’s best attorney that refusing to perform the surgeries has “increased threat of physical injury, psychological problems, and death” for LGBT soldiers.

Attorneys from the Veterans Legal Services Clinic at Yale Law School, which is TAVA’s legal representative, wrote in the text that “VA has put the organization and its members in an unstable state of purgatory, where they are constantly assured by the director that VA-provided]gender-affirmation surgery will be available.

The group’s attorneys argued on Monday that the VA has broken its legal obligations to “refrain from engaging in ridiculous wait,” and as a result, the firm is entitled to take the office to court, despite the fact that it has been more than seven years since TAVA initially filed its petition.

A common notice published in April 2022 stated that a constitutionally required cost-benefit analysis is conducted, and TAVA particularly requests that the VA publish the formal rule in the Federal Register.
