The first transgender judge in the UK is asking for permission to meet the case in a critical supreme court decision that could have a significant impact on transgender women’s constitutional protections, the Guardian has learned.
The campaign team For Girls Scotland filed an application to engage in the highest court appeal brought by Victoria McCloud, a senior legal judge who became the youngest man appointed as king of the great court in 2010. Despite not being one of the principal parties involved in the dispute, interveners can make a case.
For Women Scotland contests whether transgender women should be included in British government legislation intended to improve sex balance on open boards.
The group has been taking legal action against the Gender Representation on Public Boards ( Scotland ) Act 2018 for a long time, most recently ruling that Lady Haldane had a valid right to extend the definition of “woman” to transgender women holding a gender recognition certificate.
McCloud, who changed her constitutional sex in the late 1990s and later changed in accordance with the 2004 Gender Recognition Act, has received support in her implementation from the Good Law Project.

Due to criminal restrictions, McCloud cannot communicate directly to the internet. This would theoretically result in people like her [with a sex recognition certificate ] losing access to the same amount of money as people and having restricted access to services or techniques to force her to be removed from places like women’s lavatories, according to a friend of hers. ”
According to The Guardian, McCloud and her relatives have made arrangements to move to an EU state where she would continue to be officially recognized as a woman if the For Women Scotland appeal is successful.
In response to the toxic environment in the UK, McCloud, 54, announced last month that she would be leaving the chair in April after 14 years as a full-time determine.
She wrote in her letter of resignation to the female chief justice, leader, and vice-president of the king’s couch section, that she had come to the realization that, in the UK, the national scenario and the current judicial system no longer allowed her to be both a ‘trans ’ and a fairly well-known judge. ”
The conflicting Scottish rulings, according to For Women Scotland, which won an earlier judicial evaluation of the work, “show that a description of ‘sex’ that includes a person’s ‘acquired female ’ on a gender identification document makes the Equality Act thick and impossible for some women. The natural nature of the term sex needs to be known. ”
It argues that Haldane’s inclusive definition of “sex” finds services providers of single-sex places “confused and … at risk of legal action for unlawful discrimination”.
Describing the situation as “truly historic”, the writer and activist JK Rowling has donated £70,000 to For Women Scotland’s crowdfunder for the actions, which now sits at roughly £150,000.
Without any transgender people present, the Good Law Project’s executive director, Jo Maugham, stated:” Many of these cases, involving and having serious effects on the life of trans people, ” are decided. Trans people often have trouble getting picture because they lack tycoon funders.
