Under alterations being considered by the government, transgender police officers will only be able to remove research suspects from the same genetic sex.
Following the revelation that transgender officers were permitted to conduct personal searches of people of the opposite sex, nationwide police guidance, the policing minister, Chris Philp, has ordered an urgent review of strip-search regulations.
The guidance, which let transgender men identify themselves as female or have gender recognition certificates, was removed by the National Police Chiefs ‘ Council ( NPCC). It is now conducting a” complete” assessment of its regulations.
The move comes in response to complaints by women’s rights organizations like Sexual Things, the Children’s Rights Network, and MPs in Don Valley led by Nick Fletcher, MP for Don Valley, that their health was being compromised.
In a letter, Mr. Philp addressed Mr. Fletcher,” I understand the deep issues you, and others, have had about using sex reputation certificates during police searches.”
I want to urgently review whether legal changes are necessary to make it clear that people of the same sex should be conducting strip searches ( and not apply gender recognition certificates ).
” The office is now closely examining this issue in consultation with state equalities gateway colleagues. I’m aware of the Gender Recognition Act’s regulatory authority and may give it my full attention.
He continued,” These measures are among the police’s most aggressive capabilities.” Their use has been polite, good, and in full compliance with the law.
The State is determined to do everything in its power to protect women and girls in police custody and maintain our communities safe.
For a person to be searched by a female agent, Mr. Fletcher and children’s organizations found the action to be demeaning and scary. If the agent has a document, it is the same.
In recognition of the right to respect for private and family life ( protected by Article 8 of the European Convention on Human Rights ), the Gender Recognition Act of 2004 was passed, making it possible for transgender people to marry people of the same sex ( at the time before same-sex marriage ).
GRC is considered to be “legal literature.”
It is important to keep in mind that a female identification certificate is a legal fiction that does not alter reality and does not violate other person’s rights.
According to Maya Forstater of Gender Things, Heather Binning of the Children’s Rights Network, and Nicola Williams of Fair Play for Women, “recent legal cases have demonstrated that a person’s sex does not change for all legal reasons.”
The NPCC stated that all searches are conducted on a case-by-case foundation after a prison sergeant considers the detainee’s response.
According to the police and criminal evidence act of 1984, searches are conducted in accordance with the official or staff member’s training and lawful authority.
