The California Attorney General Applauds the District Court’s decision to support gender-affirming treatment for trans people

California Attorney General Rob Bonta issued a speech on April 10, 2024, following the U.S. District Court for the Eastern District of Alaska. The second amended complaint challenging the constitutionality of Senate Bill 107 (SB 107), also known as California’s Transgender Sanctuary State Law, is denied by California’s ruling denying the California Department of Justice’s request to dismiss it. SB 107, which was authorized by Senator Scott Wiener (D-San Francisco), provides legal protections for both doctors and staff in California who provide gender-affirming care that is unavailable where they live. It puts in place numerous safeguards to prevent the enforcement of laws from various states that would punish people for getting medically important care that is acceptable in California.

Attorney General Bonta argued that “no one should ever become marginalized for seeking the attention they need.” In light of the growing abuse on LGBTQ+ rights around the country, the judge’s decision is a significant gain for transgender children and their families in California and throughout the United States. To ensure that transgender and gender nonconforming people receive the attention they need to live happier, healthier lives, my company is prepared to support SB 107.

The claimant failed to suggest any facts that suggested SB 107 had caused the plaintiff any harm, and the court denied that claim on Article III standing grounds in the dismissal of the lawsuit.

  • In opposition to state laws in Indiana that greatly limit access to crucial, lifesaving gender-affirming treatment, Attorney General Bonta led a multistate partnership of 20 attorneys general in September 2023.
  • Attorney General Bonta led a multistate coalition in submitting an amicus brief opposing state legislation in Kentucky and Tennessee that forbids transgender students from getting essential and lifesaving medical attention in August 2023.
  • Attorney General Bonta led a multistate alliance in supporting a lawsuit challenging a Florida law barring exposure to gender-affirming care in May 2023.
