A federal appeals court has rejected a petition that seeks to overturn transgender student aid rules in Eau Claire institutions.
A group of Eau Claire kids calling themselves Kids Protecting our Kids filed the lawsuit in 2022.
The parents claimed that a gender support plan by the Eau Claire Area School District violated their constitutional rights because it does n’t require notification when students request changes to their names and pronouns, use of different bathrooms, or participate in sports teams that match their gender identity.

The kids, who are represented by the Wisconsin Institute for Law and Liberty, or WILL, and America First Legal, argued allowing a child to make those alterations without parental consent violates the U. S. Constitution’s Due Process and Free Exercise provisions.
The case was dismissed by the Seventh Circuit U.S. Court of Appeals last week after a lower provincial court’s March 2023 decision was overturned. The attempt, written by Magistrate Judge Steven Crocker, says while it’s obvious the kids “harbor legitimate concerns about possible applications of the School District’s plan” none of the parents, or their children, were affected by the plan.
” No fear Parents Protecting’s claims punch with faith and issue”, said Crocker. Nowhere in the problem is it claimed that even one of the agency’s people, or any special family, has experienced an exact or immediate damage as a result of the Administrative Guidance or a Support Plan.
Crocker added that there is no proof that any of the families inquired about the district’s plans for the transgender plan.
A representative for WILL stated that the company is “disappointed with the decision and are evaluating next steps” with regard to a possible charm to the U.S. Supreme Court.
Tim Nordin, president of the Eau Claire Area School District Board, stated to WPR that they are pleased that the authorities continue to rule that the legislation has n’t “inflicted any harm or possibly caused harm” to any parents. He claimed that since the lawsuit was filed, the policy has n’t changed.
” We are persuaded that this supports students and families, and that it also fully respects the rights of the students and families,” said Nordin. We’ll continue to back them as much as we can.
In almost all cases, according to Nordin, transgender students approach school staff with either their parents or, if they do n’t, they want to help integrating their families. He claimed that he believes the controversy involving trans children and adults is manufactured.
” It does seem, you know, nationwide, and even nationally, that it continues to be a political tool being used to separate individuals, targeting a very small minority and marginalizing them in the quest of some sort of social strength”, Nordin said.
